1. Nature of the Service

Epub2y is a technical tool that lets users package content they provide into the EPUB format and forward it to their own devices. Epub2y does not select, curate, screen, or read the content you process. Epub2y operates as a passive conduit (mere conduit) — you provide a URL, Epub2y performs the technical operation you requested. Epub2y makes no claim of, and disclaims, any affiliation, partnership, endorsement, or sponsorship with any source website.

2. User Responsibility

You are the SOLE party responsible for (a) the legality of your access to the content at the URL you provide, (b) whether you hold the rights necessary to copy that content for personal use under the law of your jurisdiction, (c) compliance with the Terms of Service and technical measures of any source site, and (d) any consequences arising from processing the content. Epub2y has no obligation and no ability to verify your rights to the content you provide.

3. Prohibited Use

You may not use Epub2y to: (a) bypass paywalls, login walls, DRM, or any access-control measures; (b) violate the robots.txt or Terms of Service of any source site; (c) perform automated mass downloading beyond reasonable personal use; (d) redistribute, sell, publicly post, or commercially exploit the resulting EPUB file; (e) process content that is unlawful, including but not limited to: child sexual abuse material, content inciting violence, unlawfully collected personal data, or third-party trade secrets. Violations result in immediate account termination and you remain solely responsible for any legal consequences — Epub2y will not defend you against any claim.

4. Indemnification

You agree to indemnify, defend, and hold completely harmless Epub2y, its operators, owners, partners, employees, and agents from and against any claim, demand, allegation, lawsuit, damage, loss, cost, and expense (including reasonable attorneys' fees and litigation costs) brought by any third party arising out of or related to (a) your use of the service, (b) the content you process through the service, (c) your violation of any third-party right including copyright, trademark, privacy, or moral rights, (d) your breach of these Terms or any applicable law, or (e) any false information you provide to the service.

5. Copyright & DMCA Notice

Packaged content is AES-256 encrypted per account and auto-deleted after 7 days. Epub2y maintains no public content library, distributes nothing to anyone but the originating account holder, and has no right or ability to control the content you provide. If you are a copyright owner (or authorised agent) and believe your work is being infringed on Epub2y, please send a DMCA notice to [email protected] containing all elements required by 17 U.S.C. §512(c)(3): (a) Identification of the copyrighted work claimed to have been infringed; (b) Identification of the infringing material with enough detail for us to locate it; (c) Your contact information (name, address, phone, email); (d) A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law; (e) A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorised to act on behalf of the copyright owner; (f) Your physical or electronic signature (or that of an authorised representative). Notices missing any element above may not be processed. Submitting a knowingly false notice may make you liable for damages under §512(f).

6. Counter-Notification

If your content was removed under a DMCA notice that you believe was mistaken or where you are authorised, you may submit a counter-notification to [email protected] containing: (a) Your physical or electronic signature; (b) Identification of the removed content and its location before removal; (c) A statement under penalty of perjury that you have a good-faith belief the removal was a mistake or misidentification; (d) Your name, address, phone number, consent to the jurisdiction of the federal court for the judicial district where you reside (or any U.S. judicial district if you reside outside the U.S.), and acceptance of service of process from the original DMCA complainant. After 10–14 business days from receipt of a valid counter-notification, we may restore the content unless the original complainant notifies us they have filed suit.

7. Repeat Infringer Policy

Pursuant to 17 U.S.C. §512(i), accounts that receive two (2) or more valid DMCA notices within a rolling period may be permanently terminated. Final discretion rests with Epub2y.

8. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE — including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, security, uninterrupted operation, error-free operation, or accuracy. Some jurisdictions do not allow exclusion of implied warranties; in that case the above exclusions apply to the maximum extent permitted by law.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Epub2y, its operators, owners, employees, partners, and suppliers SHALL NOT BE LIABLE for any direct, indirect, incidental, special, consequential, or punitive damages — including but not limited to: lost profits, revenue, data, goodwill, or business opportunity; damage to devices; cost of substitute services; or any non-monetary loss — arising out of or related to your use of (or inability to use) the service, even if advised of the possibility of such damages. Epub2y's aggregate liability for all claims by you shall not exceed the greater of five U.S. dollars (USD 5) or the total fees you paid Epub2y in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account at any time, with or without notice, for any reason or no reason, including suspected violation of these Terms. You may terminate your account at any time. The User Responsibility, Indemnification, No Warranty, and Limitation of Liability sections survive termination.

11. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Epub2y operates, without regard to its conflict-of-laws principles. Any dispute arising out of or related to the service shall be resolved in the courts of competent jurisdiction in that location. You waive any right to participate in a class action.

12. Changes to Terms

We may update these Terms at any time. The current version is always posted on this page with the last-updated date at the top. Continued use of the service after changes constitutes your acceptance of the updated Terms.
